1) TERMS OF USE :
1.1] i retain full rights to the artwork and must always be clearly credited.
you may not remove, obstruct, edit, or otherwise obscure my signature.
1.2] no modification of my artwork is permitted under any circumstances, except filters and adding a background to a .png which has a transparent background.
this is due to me being willing to make any edits at the time of purchase. my art may not be edited to fit a characters redesign.
1.3] you are not permitted to create duplicates of the commission, or any of my artwork, for profit or publicity purposes. examples include, but are not limited to: tracing, copying, or recoloring. i do not currently have any rules for commercial liscensing.
read as: do not print my artwork for merchandise unless previously communicated with me.
printing is only allowed for personal use. tracing and referencing (personal use) are also allowed as long as i am credited as the original artist if posted publicly online.
1.4] my artwork is not to be used to support any agenda which is deemed harmful or illegal. examples include, but are not limited, to: trans/homophobia, any 'philias, hate groups, MAGA, zionism, fascism, etc.
no religion excuses you from these terms stated above.
1.5] my artwork is not to be fed into artifical intellegence (AI) learning. doing so will lead to an immediate block and blacklist, along with a public callout.
this includes but is not limited to ai based: image generators, style transfer tools, lighting systems, animations or any AI based creative software.
violation of this clause constitutes as a breach of contract and may result in legal action.
2) PAYMENT :
2.1] i accept cashapp, paypal, and kofi as valid methods of payment, in that order of preference. all of my prices are listed in usd (united states dollar).
i do not accept any other methods, as i am unable to do so. if no actual payment methods can be used, i may be willing to accept payment via a deviantart commissions widget.
2.2] i do not start work on any commission unless full payment is recieved unless otherwise communicated.
by request, i can complete a sketch of your commission for approval before payment is recieved, but i will not make any continued efforts to continue your piece(s) unless i am paid in full.
2.3] if somebody else is paying for you [whether that be a parent, a friend, etc], be sure you have explicit permission, which i may ask for proof of. if i recieve an unauthorized chargeback due to you using someone else's funds without their permission, you will be held accountable and i will be filing a claim.
2.4] i do not accept art offers or character trades in return for a commission. check my pages to see if/when trades will be open.
3) SERVICES :
3.1] your art can take any length of time from 1 day to a 3 month period. please do not pressure/harass me, but you may ask for updates at any time.
if you know you will need your art quickly, a rush fee can be discussed when purchasing from me.
3.2] i have the right to decline a commission for any reason. if i cancel your commission then you will receive a refund in line with the appropriate refund policy.
i also hold the right to refuse you service if i deem you suspicious or untrustworthy for any reason. this includes, but is not limited to, blank profiles and/or accounts on my/my friend's/my partner's blacklist.
3.3] if you completely reject a sketch (as in, you need a brand new sketch), i retain the right to reuse the rejected sketch in any way i please. rejected sketches are limited to 2 (two).
3.4] i will make small changes but not large changes once the sketch has been approved and further progress has been made.
3.4.2] "large" changes are up to me to decide, but if i have to change a lot of what i have already made ill probably consider it a large change.
3.4.3] if you want large changes to the art after the lineart/colour has been completed, i will request an additional fee, or, if a resolution cannot be reached, cancel your commission.
3.4.4] if you need small edits to the art at any stage, even a long time after the art has been completed, please ask. minor edits are always free of charge.
3.5] for any art commission, i will require a proper, clear, unshaded reference sheet with the correct colors and design. i do not work from description alone, and i do not do customs; i will not design the character for you.
3.6] if you do not give a proper pose/expression description, i will either draw the character(s) the way i please or completely decline your commission.
4) REFUNDS :
4.1] i usually do not offer refunds once i have spent time on the commission, as the art process takes a while. i do have a few circumstances where a refund would be allowed:
- if the art was a gift for a partner, and you have since broken up;
- if its a genuine emergency situation where you cannot afford the art;
- if you have traded/sold a character and arent comfortable with somebody else recieving the art
other than this, i will probably not accept a full refund. partial refunds are possible, just please ask me.
5) DESIGNS :
5.1] i do not make custom designs for commissions, do not ask me for one. i do make adopts though, so watch for those.
5.2] do not upsell my designs/inflate their worths for a profit. this is extremely scammy and i have no tolerance for it.
5.3] along with the above, never give my designs away for free. this is to prevent my designs being included in giveaways and then resold by an inflated worth.
5.4] you may do anything with my design, such as: redesign, change species, color pallete, gender/sex, and anything else relating to the characters visual design.
you may not strip a design of their minority, such as: taking away a disabled characters wheelchair/cane, removing a poc characters locs, etc. dont be an asshole.
5.5] making nsfw of my designs is okay, as long as they are not a minor/child, feral, or otherwise unconsenting/illegal. i will not be involved with your paraphallic content.
also do not use my designs for anything illegal/hateful/immoral, such as maga content, propoganda, zionistic beliefs, racism, etc. it doesn't matter if i didnt list it specifically, you should have enough common sense to know its prohibited.
5.6] i do not have a public blacklist, but know that blocked = blacklisted. if you cannot access my profile, then i dont want you owning my designs. this goes both ways; if you have me blocked, then do not seek out my designs. it makes me extremely uncomfortable.
